By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. FS will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the FS Platform(s) will cease immediately.

FS may provide various services free of charge from time to time via the FS Platform(s), including newsletters, reports and other publications. No contract with FS is expressed or implied for any free service. Therefore, a guest user cannot become a registered user by using any free service. FS is not liable in any way for use of free services or for any user liabilities resulting from the use of free services.

These Terms and Conditions do not exclude or limit our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by the laws of England and Wales. To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms that may apply to the FS Platform(s) or any content thereon, whether express or implied by FS. You and FS both agree to submit to the non-exclusive jurisdiction of the English Courts.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: • use of, or inability to use, the FS Platform(s).
• use of or reliance on any content displayed on the FS Platform(s).


If you are a ‘Customer’ or ‘Advertiser’ FS will not be liable for: • loss of profits, sales, business or revenue.
• business interruption.
• loss of anticipated savings.
• loss of business opportunity, goodwill, or reputation.
• any indirect or consequential loss or damage.
• FS will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect user devices or equipment, computer programs, data or other proprietary material due to their use of the FS Platform(s) or to users downloading of any content on the FS Platform(s), or on any other Platform(s)/website(s) that may be linked to the FS Platform(s). As defined in this Agreement, FS has no liability or responsibility for the content of any other Platform(s)/website(s) that may be linked or otherwise pointed to the FS Platform(s).
No endorsement by us is given or implied in relation to those linked website(s).
We accept no liability whatsoever for any loss or damage that may arise from the use of those other platform(s) or Website(s).

You acknowledge and agree that the Company shall not be held responsible in any way for the outcome of any contact or meeting, whether in person, by telephone or any other means, resulting from advertisements placed or responded to, or messages or communications sent or received by Users or Advertisers through/via the Platform or any Platforms/websites associated with the Platform, or through any use, directly or indirectly, with the Platform. You further acknowledge and agree that the Platform cannot guarantee 100% that the security measures it uses can protect the users or Advertisers of the Platform. The Platform has no control over users actions and makes no representations or warranties with respect to the character, veracity, age, health or any other attribute of the users of the Platform, including any person who places Advertisements on/via the Platform. You further acknowledge and agree that the Platform does not endorse, encourage, recommend or arrange communications or meetings among Users of or via the Platform, or any other persons and you are expected to use your own common sense and take appropriate measures and precautions to insure your own personal safety and privacy in the event that you choose to communicate with, or meet with any person with whom you have communicated through the use of or via the Platform, or through advertisements posted on the Platform. You acknowledge that use of the Platform is at your own risk. We do not represent or endorse the accuracy of reliability of any advice, opinion, statement or other information displayed, uploaded or distributed through/via the Platform or by a user of the Platform or any other person or entity.

If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its termination. FS and its affiliates disclaim all liability arising from any fraudulent activity in connection with and not limited to entering our Platform/gaining access to our platform and all content within. We will terminate or suspend anyone who we think has provided information that is untrue, not complete, or not current and refuse any current or future access to this and all our Platform(s). You could also face criminal and/or civil charges. You agree you are responsible and will payback any losses we have incurred due to any misrepresentation we think you have made, this includes but not limited to credit card and cheques that have not been honoured, reversed or charged back and all related fees associated with you or/and your account. All money owed must be paid within 30 days otherwise interest at 8% will be charged on the amount owed and fees incurred by us. We may also notify your issuer during our investigations to make sure that nothing untoward has happened to your financial account and court action may be taken.

This Agreement shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts regardless of the laws that might be applicable under principles of conflicts of law. The parties agree that the courts of the United Kingdom, shall have exclusive jurisdiction over all controversies arising under this agreement and agree that venue is proper in those courts. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded.
